Our store is hosted on Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products and services to you.

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

Headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your device’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit quantities of any products or services. All descriptions of products or pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.


SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders using the same billing or shipping address.

In the event that we make a change to or cancel an order, we may notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

In no case shall Nuovo Luxury, our directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages; in such cases, our liability shall be limited to the maximum extent permitted by law.


SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nuovo Luxury, its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms or your violation of any law or rights of a third party.


SECTION 15 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of any other provisions.


SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to termination shall survive termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate at any time by notifying us you no longer wish to use our services, or when you cease using our site.

If you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and you remain liable for all amounts due.


SECTION 17 - ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us constitute the entire agreement and understanding between you and us and supersede any prior agreements, communications, or proposals.

Any ambiguities in interpretation shall not be construed against the drafting party.


SECTION 18 - GOVERNING LAW

These Terms and any agreements for services provided shall be governed by and construed in accordance with the laws of the United Kingdom.

We reserve the right to update, change, or replace any part of these Terms at any time. Your continued use or access of our site following changes constitutes acceptance of those changes.

SECTION 20 - FLATPACK SAUNA DISCLAIMER

For customers purchasing our flatpack saunas, the following terms apply in addition to our standard Terms of Service:

  1. No Refunds or Returns: Once the product is accepted upon delivery, no refunds or returns will be granted. Acceptance at the time of delivery is considered final approval of the product.

  2. Customer Responsibility for Ground Preparation: It is the customer's responsibility to ensure that the installation site has a solid, level base. Nuovo Luxury LTD is not liable for any operational issues, such as misalignment of doors or walls, that arise due to an improper or unlevel foundation.

  3. Delivery and Offloading Assistance: Customers are required to assist with offloading the sauna from the delivery vehicle. Failure to provide the necessary assistance may result in additional charges or delays, for which Nuovo Luxury LTD is not responsible.

  4. Assembly Service: If assembly services have been purchased from Nuovo Luxury LTD, Nuovo Luxury LTD will endeavour to schedule assembly within 10 business days following delivery. While we aim to provide timely service, exact dates cannot be guaranteed.

  5. Post-Delivery Storage: Customers are responsible for storing the sauna in a dry and secure environment after delivery. Nuovo Luxury LTD will not be liable for any damage resulting from improper storage conditions.

  6. Issue Reporting and Service Policy: All issues or defects with your product must be reported within 48 hours of delivery or assembly. We strongly recommend thoroughly inspecting the sauna upon delivery and after assembly to ensure everything is in proper working order.

    If any issues are reported after this 48-hour period, we can arrange for a service visit. However, please note that these visits will incur a charge of £250 +VAT per visit. This fee covers the cost of the technician and any necessary travel or inspection. By purchasing our flatpack saunas, you acknowledge and agree to these terms.

By completing your purchase, you acknowledge that you have read, understood, and agreed to these terms. Nuovo Luxury LTD will not be liable for any penalties, claims, or refunds under the circumstances outlined above.

 

Important Disclaimer – Sauna Installation & Maintenance

 


Our outdoor saunas are crafted from high-quality natural timber and are designed for year-round outdoor use. However, as a natural material, wood will react to environmental conditions such as moisture, temperature fluctuations, and sun exposure. This is not considered a fault but a characteristic of the material.


Proper installation, treatment, and ongoing care are essential to protect your sauna and preserve its structural integrity.


By purchasing this sauna, the customer accepts full responsibility for:

 

  • Ensuring appropriate spacing is provided around the sauna for airflow, drainage, and maintenance access (we recommend at least 30cm clearance on all sides).

  • Installing the sauna on a firm, level base (ideally concrete or decking) that allows for adequate drainage.

  • Treating the sauna with a suitable breathable wood oil or stain immediately upon installation and reapplying regularly, especially before and after winter.

  • Keeping the area around the sauna clear of stones, soil, plants, or any material that could obstruct ventilation or retain moisture near the base.

  • Inspecting and maintaining the structure regularly, including re-securing any fixings and resealing joints if needed.

 


Failure to follow these requirements may void your warranty. Structural movement, panel warping, or base bowing caused by incorrect installation, insufficient maintenance, or environmental exposure will not be covered under warranty.

SECTION 21 - PRE-ASSEMBLED SAUNA DISCLAIMER

Pre-Assembled Sauna Disclaimer

By purchasing a pre-assembled sauna from Nuovo Luxury Ltd, you agree to the following terms and conditions:

  1. No Order Cancellations: Once payment has been made, orders for pre-assembled saunas cannot be cancelled under any circumstances. All sales are final.

  2. Electrical Setup Responsibility: It is the customer’s responsibility to ensure that the electrical setup at the installation site is adequate for the sauna. You must hire a fully qualified and certified electrician to verify that the sauna heater, lights, and any other electrical components have sufficient power and are safely installed. Nuovo Luxury Ltd will not be responsible for, nor held liable for, any faults, damages, or injuries that result from improper electrical setup or insufficient power supply.

  3. Ground Preparation: The customer must ensure that the installation site has a solid, level base. Nuovo Luxury Ltd will not be liable for any damage to the sauna caused by an uneven or unstable foundation. Any issues that arise from improper ground preparation, including misalignment or structural damage, are the sole responsibility of the customer.

  4. Crane Delivery: If the customer chooses to arrange their own crane for delivery and installation of the sauna, Nuovo Luxury Ltd will not be liable for any damages that occur during the lifting, positioning, or unloading of the sauna. All risks associated with the crane delivery process, when arranged by the customer, are borne solely by the customer.

  5. Delivery Rescheduling Costs: If a delivery is delayed or needs to be rescheduled on the day of delivery due to issues with the crane company, the delivery vehicle, or any other unforeseen circumstances, Nuovo Luxury Ltd will not be held liable for any additional costs incurred as a result. The customer will be responsible for any rescheduling fees, additional crane hire charges, or other related costs that arise from such delays or the need to reschedule.

  6. Acceptance of Delivery: Once the sauna has been delivered to the customer’s site, it is considered accepted by the customer. At the point of delivery, all responsibility for the sauna, including any risk of damage or loss transfers to the customer. Any claims or complaints must be reported immediately upon delivery, as no further claims will be accepted once the delivery has been completed and acknowledged.

  7. Two-Year Warranty: Nuovo Luxury Ltd provides a two-year warranty covering any faults with the sauna heater or lights. This warranty is valid only if the electrical installation has been carried out and certified by a fully qualified electrician, as specified in these terms. The warranty does not cover faults or damages resulting from improper electrical setup, misuse, or failure to follow installation instructions.

  8. At Nuovo Luxury Ltd, we strive to represent our products as accurately as possible through the images and descriptions on our website. However, please be aware that all our Halo Saunas and pre-assembled saunas are made to order, and as a result, slight variations in colour, design, dimensions, and materials may occur due to the handcrafted nature of our products and the availability of materials.

    By purchasing our products, you acknowledge and accept that:

    • Variations May Occur: The final product may have minor differences from the images displayed on our website, including but not limited to texture, finish, and other aesthetic details.

    • No Liability for Variations: Nuovo Luxury Ltd shall not be held liable for any such slight variations or differences between the website images and the delivered product.

    • Custom Orders: Since each sauna is custom-made, returns or exchanges based on these slight variations are not accepted unless the product differs significantly from the agreed-upon specifications at the time of purchase.

By proceeding with the purchase, you acknowledge that you have read, understood, and agreed to these terms and conditions. Nuovo Luxury Ltd will not be held responsible for any liabilities arising from the failure to adhere to these requirements.

It is the client’s responsibility to ensure that any necessary planning permission or building regulation approval is obtained prior to installation. Nuovo Luxury Ltd will not be held liable for any costs, delays, or alterations resulting from planning or compliance issues.

SECTION 22 - Pergola Disclaimer

At Nuovo Luxury Ltd, we are dedicated to delivering high-quality, custom-made pergolas designed to your specifications. To ensure clarity and mutual understanding, please be aware of the following terms and conditions:

  1. Approval of Drawings and Measurements

    • Customer Responsibility: Upon receiving the drawings and measurements for your pergola, it is your responsibility to review and confirm that all details are accurate and meet your requirements.
    • Agreement to Specifications: By proceeding with the order, you acknowledge and agree to the provided drawings and measurements.
    • Liability: Nuovo Luxury Ltd shall not be held liable for any issues arising from inaccuracies in the drawings and measurements once they have been approved by you.

  2. Site Preparation and Installation

    • Level Ground Requirement: The installation site must be level and properly prepared prior to installation. An uneven or unprepared site may cause installation difficulties or structural issues.
    • Customer Obligation: Ensuring the ground is level is the customer's responsibility. We recommend consulting a professional if you're unsure about site suitability.
    • Liability for Site Conditions: Nuovo Luxury Ltd is not liable for problems caused by unsuitable site conditions, including additional costs or delays resulting from necessary adjustments.

  3. Shipping and Delivery Delays

    • Potential Delays: Delivery times are estimates and may be affected by factors beyond our control, such as delays at sea, customs inspections, or other logistical issues.
    • No Liability for Delays: Nuovo Luxury Ltd is not responsible for any delays in delivery or any costs incurred due to such delays.
    • Scheduling Installation: Installation dates will be scheduled once your pergola has arrived in the UK and is in our possession. We cannot provide an exact installation date before this time.

  4. Force Majeure

    • Uncontrollable Events: We shall not be liable for any failure to fulfill our obligations due to events beyond our reasonable control, including but not limited to natural disasters, transportation disruptions, or acts of government authorities.

  5. Acceptance of Terms

    • Agreement: By proceeding with a purchase from Nuovo Luxury Ltd, you acknowledge that you have read, understood, and agreed to this disclaimer and the terms and conditions herein.


      It is the client’s responsibility to ensure that any necessary planning permission or building regulation approval is obtained prior to installation. Nuovo Luxury Ltd will not be held liable for any costs, delays, or alterations resulting from planning or compliance issues.

 

SECTION 23 - CANCELLATION & DEPOSIT POLICY

Please note that once an order has been placed, any deposit paid is non-refundable in the event of cancellation. While our flatpack saunas are not custom-made, significant preparation goes into processing your order, including product allocation, logistics, and arranging delivery schedules. By placing your order and paying a deposit, you are agreeing to these terms.

Mobile Terms of Service

The Nuovo Luxury mobile message service (the "Service") is operated by Nuovo Luxury (“Nuovo Luxury”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Nuovo Luxury’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Nuovo Luxury through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Nuovo Luxury. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to NuovoLuxury or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Nuovo Luxury mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

For Service support or assistance, text HELP to NuovoLuxury or email support@nuovoluxury.co.uk.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
